1. Personal Data

The law firm RA Lukas Slameczka, LL.M. (WU), appearing under espresso.legal, collects, processes and uses your personal data only with your consent or mandate or order for the purposes agreed with you or if another legal basis in accordance with the GDPR exists; this in compliance with data protection and civil law provisions.

Only such personal data is collected that is required for the performance and processing of legal services or that you have voluntarily provided to us.

Personal data is any data that contains individual information about personal or factual circumstances, such as name, address, email address, telephone number, date of birth, age, gender, social security number, video recordings, photographs, voice recordings of individuals, and biometric data such as fingerprints or DNA profiles. It may also include sensitive data, such as health data or data related to criminal proceedings.

2. Mandate

In the context of a mandate relationship, I represent your rights with effort, loyalty and diligence. Therefore, in your interest, I am required by law to collect all personal data about you that is necessary for comprehensive representation. Your personal data will be processed based on the underlying retainer agreement, your consent, legal and/or contractual obligations, and other purposes covered by data protection laws. For statistical matters, your personal data will be anonymized before being used.

3. Information & Deletion

As a client and generally as a data subject, you have the right to obtain information about your stored personal data, their origin and recipients and the purpose of data processing at any time – subject to the lawyer’s duty of confidentiality – as well as the right to rectification, data transfer, objection, restriction of processing and blocking or deletion of incorrect or inadmissibly processed data. Insofar as there are changes to your personal data, I request that you inform me accordingly.

You have the right to revoke your consent to the use of your personal data at any time. Your request for information, deletion, correction, objection and/or data transfer, in the latter case, provided that this does not involve a disproportionate effort, may be addressed to the address of the law firm indicated in point 12 below.

If you are of the opinion that the processing of your personal data by me violates the applicable data protection law or that your data protection claims have been violated in any other way, you have the possibility to complain to the competent supervisory authority. The competent authority in Austria is the data protection authority.

4. Data Security

Your personal data is protected by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, illegal or even accidental access, processing, loss, use and manipulation.

Notwithstanding efforts to maintain a reasonably high level of due diligence at all times, it cannot be ruled out that information you disclose to us via the Internet may be viewed and used by other persons.

Please note that I therefore do not accept any liability whatsoever for the disclosure of information due to errors in data transmission not caused by me and/or unauthorized access by third parties (e.g. hack attack on email account or telephone, interception of faxes).

5. Use of Data

I do not use / process the provided data for purposes other than those covered by the mandate agreement or by your consent or otherwise by a provision in accordance with the GDPR. This excludes the use for statistical purposes, provided that the data provided has been anonymized.

5.1 Website

The use of this website, including access to the content publicly available there, is generally possible without providing your personal data. Only the information provided by your Internet provider is recorded, including in particular the IP address assigned to you and the date, duration and time of your visit, as well as the name and version of your web browser. This information is stored by us for the duration of your visit to our website; it is evaluated solely for statistical purposes while preserving the anonymity of individual users (for more information, see point 9 below), as well as in order to be able to detect, prevent and investigate any attacks on our website. 

For these aforementioned purposes, your personal data will be transmitted to contracted IT service providers. Personal data about you will also be collected if you voluntarily and expressly enter it when visiting the website in connection with the use of the services offered on the website (e.g. to book an appointment). Such information is used exclusively for the corresponding function and in compliance with the applicable legal provisions. 

The legal basis for the aforementioned processing of your personal data is thus, on the one hand, the legitimate interest in ensuring the functionality and security of this website or the consent you have given to the processing of your personal data, which you can revoke at any time with immediate effect.

5.2 Newsletter

In order to provide you with my newsletter, you only need to disclose your e-mail address. The legal basis for the aforementioned processing of your personal data is your consent, which you may withdraw at any time and with immediate effect, or a legitimate interest of espresso.legal to maintain business contacts, to inform existing as well as potential clients, if permitted by the applicable national law.

5.3 Contact Management

When you contact me, your contact details are stored in my IT system. The processing of your contact data serves the fulfillment of my contractual and legal obligations or is in my legitimate interest to optimize the internal contact management of the law firm. Of course, you may object to the further processing of your data at any time with immediate effect. In case of your justified objection, the situation will be reviewed and I will stop processing your data, adjust it or show compelling reasons worthy of protection that require further data processing. However, your justified objection requires that your data will continue to be processed until clarification with you. 

6. Transfer of Data to Third Parties

In order to fulfill your order, it may also be necessary to forward your data to third parties (e.g. opposing parties, substitutes, insurance companies, service providers commissioned by me, to whom data is made available, etc.), courts or authorities. Your data will only be forwarded on the basis of the DSGVO, in particular for the fulfillment of your order or on the basis of your prior consent.

Furthermore, we inform you that in the context of legal representation and support, factual and case-related information is also regularly obtained from third parties.

Some of the above-mentioned recipients of your personal data are located outside your country or process your personal data there. The level of data protection in other countries may not be the same as in Austria. However, we only transfer your personal data to countries for which the EU Commission has decided that they have an adequate level of data protection or we take measures to ensure that all recipients have an adequate level of data protection for which we conclude standard contractual clauses (2010/87/EC and/or 2004/915/EC).

7. Notification of Data Breaches

I always endeavor to ensure that data mishaps are identified at an early stage and, if necessary, reported to you or the relevant supervisory authority without delay, including the respective categories of data concerned.

8. Storage of Data

Data will not be kept longer than necessary to fulfill contractual or legal obligations and to defend against any liability claims.

9. Cookies

This website uses “cookies” to make the website offer more user-friendly, effective and secure.

A “cookie” is a small text file that we transfer via our web server to the cookie file of the browser on the hard drive of your computer. This enables the website to recognize you as a user when a connection is established between our web server and your browser. Cookies help to determine the frequency of use and the number of users of Internet pages. The content of the cookies used here is limited to an identification number that no longer allows any personal reference to the user. 10. Server Log-Files

In order to optimize this website in terms of system performance, user-friendliness and provision of useful information about the services offered here, the website provider automatically collects and stores information in so-called server log files, which your browser automatically transmits. This includes your Internet protocol address (IP address), browser and language setting, operating system, referrer URL, your Internet service provider and date/time.

This data is not merged with personal data sources. I reserve the right to check this data retrospectively if concrete indications of illegal use become known.

11. Google Analytics

This website uses Google Analytics, a web analytics service provided by Google. Google Analytics relies on cookies. The information generated by cookies about your use of this website (including your IP address) will be transmitted to and stored by Google on servers in the United States. This website is set up in such a way that IP addresses are only processed in abbreviated form in order to exclude a direct reference to a person. The anonymization is used to exclude the reference to individuals.

Google will not associate your IP address with any other data held by Google. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you by Google in the manner and for the purposes set out above.
